We’ll pay AAA filing fees for claims under $10,000
Each party pays their own attorney fees
Arbitrator may award fees to prevailing party if law allows

Arbitration in your county of residence
Or another mutually agreed location
May be conducted remotely if parties agree

Small Claims Court

Exception to Arbitration:

You may bring claims in small claims court
If your claim qualifies for that court
In your county of residence
Small claims court limits apply (typically under $5,000-$10,000)

Class Action Waiver

NOT as part of a class action

No Class Arbitrations:

Arbitrator may not consolidate claims
May not preside over class proceedings
Must arbitrate only individual claims

The arbitration agreement is void
Dispute may proceed in court
But still subject to other terms here

Intellectual property disputes
Injunctive or equitable relief
Disputes regarding indemnification
Collection of unpaid fees

Either Party May Seek:

Temporary restraining orders
Preliminary injunctions
Emergency relief in court before arbitration

Time Limit for Claims

You Must Bring Claims:

Within one (1) year of when the claim arises
Or the claim is permanently barred
Applies to arbitration and court claims

Opt-Out of Arbitration

You Can Opt Out:

Within 30 days of first accepting these Terms
Send written notice to our contact address
Include your name, email, and clear opt-out statement
If you opt out, disputes go to court (see Governing Law below)
